1. Agreement to These Terms

By visiting hannibaldance.com, submitting a form, opting into SMS, donating, registering, attending an event, taking a lesson, or otherwise using the Services, you agree to these Terms and to our Privacy Policy, which is incorporated by reference.

If you use the Services on behalf of another person (including a minor), you represent that you have authority to bind that person and yourself.

2. About HASA and the Website

HASA is a community organization that offers social dancing opportunities and lessons in the tri-state area, including events in Hannibal, Missouri, and Quincy, Illinois. HASA is not a nightclub, not a licensed medical or fitness provider, and not a professional dance-competition sanctioning body.

hannibaldance.com provides information about events and programs. Website content is for general information only and may change without notice. Posted times, prices, instructors, music, and venues are not guarantees.

Instructors, DJs, musicians, photographers, and helpers may be volunteers or independent contractors, not employees of HASA. Their presence does not create an employment, partnership, joint-venture, or agency relationship with you or among them, except as a written agreement expressly states.

3. Eligibility and Minors

You must be at least 18 years old to use website forms, create accounts (if any), or opt into the SMS program.

Minors may attend an event only if a parent or legal guardian is present and remains responsible for the minor at all times, unless HASA has given prior written approval for a different arrangement. The parent or guardian agrees to these Terms on the minor’s behalf and agrees to supervise the minor. HASA has no duty to provide childcare or specialized supervision.

HASA may refuse admission, require a guardian, or remove any person, including a minor, at its sole discretion.

4. Website Rules

You agree not to:

  • Use the site for any unlawful, harassing, defamatory, or fraudulent purpose
  • Attempt to probe, scrape, overload, reverse engineer, or disrupt the site
  • Submit false information or impersonate another person
  • Post malware, spam, or unauthorized advertising
  • Copy site content except for personal, non-commercial reference
  • Frame or mirror the site without our prior written consent

We may suspend or block access at any time, with or without notice, and without liability.

5. Events, Lessons, and Social Dancing

Attendance is voluntary. A partner is not required unless an event description says otherwise. Skill levels vary. Lessons are recreational community instruction, not private professional coaching unless separately arranged in writing.

You are responsible for following event instructions, venue rules, and any posted or verbal safety guidance. You must wear footwear and clothing suitable for social dancing and the specific floor. High-grip athletic shoes may be discouraged at some events.

HASA does not guarantee that any instructor, volunteer, or attendee will dance with you, or that you will learn any particular figure or style.

6. Assumption of Risk

Social dancing, lessons, live music, and related activities involve inherent risks. These include, without limitation: slips, trips, falls, collisions, twisted joints, bruises, sprains, broken bones, head or neck injury, heart or breathing events, hearing discomfort, allergic reactions, property loss or theft, and interactions with other attendees. Floors, lighting, stages, stairs, parking areas, sidewalks, and third-party venues may be uneven, crowded, dim, or otherwise hazardous. Alcohol may be served by venues that HASA does not control. Live musicians and recorded music may be loud.

You knowingly and voluntarily assume all risks, both known and unknown, arising out of or related to your attendance, participation, travel to or from events, use of the website, or receipt of communications, even if those risks arise from the ordinary negligence of HASA or Released Parties (defined below), to the maximum extent permitted by Missouri law.

There is no blanket prohibition of moves that are parts of recognized dance styles. It is expected that you only perform moves that incur any level of danger where all those involved are willing participants. HASA assumes no liability, and we expect that all parties participating are taking full responsibility for themselves knowing that many dance moves depend on both partners performance for safe execution.

7. Release and Waiver

“Released Parties” means HASA and its officers, directors, founders, organizers, members, volunteers, instructors, DJs, musicians, photographers, contractors, agents, successors, and assigns, and, to the extent they are providing space or services in connection with a HASA event, host venues and their owners, employees, and agents.

To the maximum extent permitted by law, you release, waive, discharge, and covenant not to sue the Released Parties from and against any and all claims, demands, damages, losses, costs, and liabilities of every kind, whether known or unknown, arising out of or related to the Services, including personal injury, death, property damage, defamation, publicity, privacy, or civil-rights claims, including claims arising from the ordinary negligence of any Released Party.

This release does not apply to conduct that Missouri law does not allow to be released in advance (for example, where a statute expressly forbids waiver). Nothing in these Terms limits liability that cannot legally be limited.

If you attend with a guest or minor, you make this release on their behalf as well, to the extent permitted by law.

8. Fitness and Medical Responsibility

You represent that you are physically and mentally able to participate. Dance can be athletic. You should consult a physician if you have any health concern. You must stop participating if you feel pain, dizziness, or distress.

HASA does not provide medical care. If emergency services are called, you authorize reasonable aid and agree you are responsible for resulting costs. You should not rely on organizers to know your medical conditions.

9. Code of Conduct

HASA aims to host a welcoming community. You agree to:

  • Respect “no thank you” when someone declines a dance
  • Refrain from harassment, discrimination, stalking, unwanted touching, intoxication that endangers others, and illegal activity
  • Follow venue rules, including rules about alcohol, age, bags, and photography
  • Not recruit, solicit, or film commercially without HASA’s prior written consent

HASA may warn, refuse entry, require you to leave, ban you from future events, delete form submissions, and/or contact venues or law enforcement. Those decisions may be made in HASA’s sole discretion, with or without stating a reason, and without refund. HASA has no obligation to investigate every complaint or to disclose its conclusions.

10. Photos, Video, and Publicity

By attending, you grant HASA and the Released Parties a perpetual, worldwide, royalty-free license to use your name, likeness, voice, and performance in photos, video, audio, livestreams, and testimonials for any legitimate HASA purpose, including promotion, fundraising, archives, and press. You waive any right to inspect or approve finished media and any claim for compensation or for violation of publicity or privacy rights, to the maximum extent permitted by law.

Other attendees may also take pictures. HASA is not responsible for third-party photos. If you want to avoid close-up promotional use, notify an organizer or photographer at the event. Wide shots and incidental appearances may still occur.

11. Tickets, Donations, and Refunds

Cover charges, lesson fees, and donations support venue costs, music, advertising, instructors, and related expenses. Unless a specific event listing expressly promises a refund:

  • Donations are voluntary and non-refundable
  • Event fees are generally non-refundable once paid
  • HASA may, in its sole discretion, offer a credit, transfer, or refund

Posted prices may change. A listed price is not a binding offer until HASA accepts your registration or payment. Chargebacks initiated without first contacting HASA may result in denial of future attendance.

You are responsible for any processing fees charged by Venmo, PayPal, card processors, or similar services.

12. Cancellations and Changes

HASA may cancel, postpone, relocate, or alter any event, lesson, instructor, set list, or schedule at any time, including for weather, venue issues, low attendance, instructor illness, safety, or any other reason. HASA is not liable for your travel, lodging, time, or other costs. We will try to provide notice through the website, social media, email, and/or SMS when practical, but we do not guarantee notice.

13. SMS / Text Message Terms

If you opt into HASA texts, you agree to receive recurring automated text messages from Hannibal Area Swing Association about events, lessons, social dances, reminders, cancellations, weather or venue changes, and related announcements.

Frequency: Message frequency varies. You will typically receive no more than 8 text messages per month. In months with more events than usual, you may occasionally receive more.

Message and data rates may apply.

Text HELP for help. Text STOP to cancel. Consent is not required to attend events or to make a purchase or donation.

Web opt-in requires an affirmative, unchecked consent box. We will not pre-select consent.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text-messaging originator opt-in data and consent will not be shared with any third parties.

You represent that you are the owner or authorized user of the mobile number you provide and that you are at least 18. You agree to notify us if your number changes. You are responsible for charges from your carrier. Carriers are not liable for delayed or undelivered messages.

HASA is not liable for messages that fail to send, arrive late, are filtered, or are read by someone else who has access to your phone.

See the Privacy Policy for how mobile numbers are handled.

14. Intellectual Property

The website, logos, event names (including “Second Story Swing” and other HASA event branding), copy, graphics, photos owned by HASA, playlists compiled by HASA, and similar materials are owned by HASA or its licensors. You may not copy, sell, scrape, or commercially reuse them without prior written permission.

Music performed or played at events is licensed, if at all, by the venue, musicians, or applicable performing-rights arrangements. You may not record sets for commercial distribution.

15. User Content

If you submit comments, testimonials, photos, or other content, you grant HASA a non-exclusive, perpetual, worldwide, royalty-free license to use, edit, and display that content in connection with the Services. You represent that you own the content and that it does not infringe others’ rights. We may refuse or remove any content at any time.

16. Third Parties and Venues

Events are often held at independent venues. Those venues, as well as Facebook, payment apps, map providers, and other linked services, are not under HASA’s control. You must follow their rules. HASA is not responsible for their acts, omissions, food, alcohol service, security, parking, Wi-Fi, cameras, or accessibility, except to the extent Missouri law makes such a disclaimer unenforceable.

17. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, HASA AND THE RELEASED PARTIES DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE OR TEXTS WILL BE UNINTERRUPTED, ACCURATE, OR ERROR-FREE, OR THAT EVENTS WILL MEET YOUR EXPECTATIONS.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE RELEASED PARTIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF THE RELEASED PARTIES FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO HASA FOR THE SPECIFIC EVENT GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) FIFTY U.S. DOLLARS (US $50). IF YOU PAID NOTHING, THE CAP IS US $50.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS. IN THAT CASE, THE LIMITATION APPLIES TO THE FULLEST EXTENT PERMITTED.

19. Indemnification

You agree to defend, indemnify, and hold harmless the Released Parties from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your attendance or conduct; (b) your guest or minor; (c) your user content; (d) your violation of these Terms or law; (e) your infringement of another person’s rights; or (f) a dispute between you and another attendee. HASA may assume exclusive defense of any matter, at your expense, and you will cooperate.

20. Governing Law and Disputes

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law rules, except that the Federal Arbitration Act would apply to any arbitration if the parties later agree in writing to arbitrate a particular dispute.

Before filing a claim, you agree to contact HASA and attempt good-faith informal resolution for 30 days.

Except for claims that may be brought in small-claims court, you and HASA agree that any dispute shall be brought only individually, not as a class, collective, consolidated, or representative action. You waive any right to participate in a class action against HASA or the Released Parties to the maximum extent permitted by law.

Exclusive venue and jurisdiction lie in the state courts located in Marion County, Missouri, or the U.S. District Court for the Eastern District of Missouri, except that HASA may seek injunctive relief in any court of competent jurisdiction to protect its name, safety, or intellectual property.

You must file any claim within one (1) year after it accrued, or the claim is permanently barred, to the extent a shorter period is allowed by law.

21. General Provisions

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and HASA regarding the Services and supersede prior understandings on that subject. Additional event-specific waivers may also apply and control to the extent they add protection for HASA.
  • If a provision is unenforceable, it will be modified to the minimum extent needed to make it enforceable, or severed, and the rest remains in effect.
  • No waiver. A failure to enforce a provision is not a waiver.
  • You may not assign these Terms. HASA may assign them.
  • No third-party beneficiaries except Released Parties, who may enforce the release, limitation, and indemnity provisions.
  • Headings are for convenience only.
  • We may revise these Terms by posting an updated version on hannibaldance.com. Continued use after the “Last Updated” date constitutes acceptance.
  • Sections that by their nature should survive (including risk, release, media license, payment, SMS non-sharing, disclaimers, liability limits, indemnity, and disputes) survive termination.
